Terms of Service

1. Acceptance of Terms
By accessing or using the LogiTrack platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, you may not use the Service. These Terms apply to all users, including business administrators, dispatchers, drivers, and other individuals granted access.
2. Description of Service
LogiTrack provides a delivery management platform with:
- Real-time driver tracking and fleet visibility
- Delivery assignment, dispatch, and workflow management
- Proof of delivery capture (photos, signatures, GPS coordinates)
- Immutable audit trails and delivery records
- Automatic cost attribution and delivery accounting
- Performance analytics and operational reporting
LogiTrack may modify, suspend, or discontinue any part of the Service with at least 48 hours' notice for scheduled updates. Emergency downtime may occur without notice for security or critical system issues.
3. Account Registration and Access
3.1 Account Creation
Accounts must be registered and onboarded by LogiTrack. You are responsible for all activity under your account and for maintaining credential confidentiality.
3.2 User Roles
LogiTrack supports multiple user roles (Super Admin, Admin, Dispatcher, Driver). Administrators must ensure appropriate role assignments.
3.3 Account Security
Notify LogiTrack immediately of unauthorized access or security breaches. Users are liable for all actions performed under their account.
4. Pricing and Payment
4.1 Per-Delivery Charges
LogiTrack charges a per-delivery fee based on the plan agreed during onboarding. A delivery is considered successful — and therefore billable — when all required proof of delivery fields (photo, signature, GPS timestamp) are verified. Current plan rates are:
- Starter: N$5 per delivery (up to 5 drivers, 500 parcels/month)
- Growth: N$8 per delivery (up to 10 drivers, 2,000 parcels/month)
- Professional: N$12 per delivery (up to 30 drivers, 8,000 parcels/month)
- Fleet: Custom pricing (50+ drivers, 10,000+ parcels/month)
Your applicable rate is confirmed in writing at onboarding. LogiTrack reserves the right to revise plan pricing with 30 days' written notice. Existing clients retain their agreed rate for the duration of the current billing period.
4.2 Failed or Cancelled Shipments
No charges apply for shipments that are cancelled, returned, failed, or otherwise not completed to the point of verified delivery.
4.3 Billing
Invoices are based on verified deliveries within the billing period. Payment terms are agreed during onboarding. Accounts overdue by more than 14 days may be suspended until payment is received.
4.4 Free Trial
One free 90-day trial per company. All platform features are available at no cost during the trial period. No credit card is required. Trial users may not combine multiple trials or request refunds. After the trial period, continued use requires agreement to a paid plan.
5. Acceptable Use
You agree not to:
- Use the Service unlawfully or violate any applicable laws
- Attempt unauthorized access to the Service or related systems
- Interfere with system integrity or performance
- Reverse engineer, decompile, or disassemble any portion of the Service
- Transmit malicious code or harmful data
- Share account credentials with unauthorized parties
- Alter or manipulate delivery records, audit trails, or system data
Violation may result in suspension or termination of access.
6. Data and Privacy
6.1 Data Ownership
All delivery data and operational records remain your property. LogiTrack does not sell or share your data for marketing purposes.
6.2 Data Collection
We collect data necessary to provide the Service, including delivery information, GPS location (for active deliveries), proof of delivery media, and usage analytics.
6.3 Data Retention
Records are retained for the duration of your account and for 24 months post-termination for compliance or dispute resolution. Users may request data export or deletion within 30 days of termination.
6.4 Data Security
Data is encrypted in transit (TLS 1.2+) and at rest (AES-256). Access is role-based and logged. Breach notifications will be issued within 72 hours.
7. Intellectual Property
LogiTrack owns all intellectual property, including platform code, design, branding, and documentation. Users may not use LogiTrack trademarks, logos, or branding without written consent.
8. Service Availability
While LogiTrack strives for high availability, uninterrupted access is not guaranteed. Scheduled maintenance notifications will be provided at least 48 hours in advance. Emergency downtime may occur without notice.
9. Limitation of Liability
To the maximum extent permitted by law:
- LogiTrack is provided "as is" without warranties
- LogiTrack is not liable for indirect, incidental, special, consequential, or punitive damages
- Total liability is limited to the total amount paid in the 12 months preceding any claim
- LogiTrack is not responsible for losses arising from driver actions, operational decisions, or failed deliveries
10. Termination
10.1 By You
You may stop using the Service at any time. No long-term contracts or cancellation fees apply. Contact support to deactivate your account.
10.2 By LogiTrack
Access may be suspended or terminated for:
- Violation of these Terms
- Fraudulent activity
- Non-payment after reasonable notice
10.3 Effect of Termination
Access is revoked upon termination. Data export requests must be made within 30 days; thereafter, data may be permanently deleted.
11. Changes to Terms
LogiTrack may update these Terms. Material changes will be communicated via the platform or email. Continued use constitutes acceptance of the revised Terms.
12. Governing Law
These Terms are governed by the laws of the Republic of Namibia. All disputes are subject to the exclusive jurisdiction of Namibian courts.
